DEFINITIONS

• Fit Friends Reward Program means the rewards program offered by Fitness First for the referral of new members to Fitness First as described in these Terms and Conditions.
• Reward means the goods and services described in the current promotional material or otherwise offered by Fit Friends Reward Program during the Promotional Period and includes as applicable Fitness First Workout Accessories, Fitness  First Bio-Age Health Assessment , Fitness Ball, Apple i-pod, Fitness First Outdoor training and New Balance Cross Trainers.
• Fitness First means Fitness First Australia Pty Ltd ABN: 65 094 778 622.
• Administrator means Global Red Pty Ltd ABN: 92 082 096 599
• Vouchers are personalised unique numbered vouchers given to a Fitness First member when they introduce an Eligible Friend to Fitness First who joins on an Eligible Membership.
• Reward Certificates are certificates given to you when you redeem your Reward Voucher for a reward.
• Eligible Membership means any Fitness First Lifestyle or Premier membership or minimum 3 month up front membership.
• Eligible Member means someone who joins on an Eligible Membership.
• Bank means a Reward Voucher is registered and saved but not redeemed.
• Eligible Friend means the friend has not been a member of Fitness First in the last three (3) months.
• Referring Member means the member who referred an Eligible Friend to join Fitness First and subsequently becomes part of the Fit Friends program.

HOW TO CLAIM:

1. To qualify for a Reward from the Fit Friends Rewards Program simply refer an Eligible Friend to Fitness First. Once the Eligible Friend has joined on an Eligible Membership you will be contacted by Fitness First when your Reward Voucher becomes available at your local Fitness First club. The Referring Member will need to collect their Reward Voucher from Fitness First at their own discretion and show photo ID as proof of identity upon collection. This Reward Voucher will entitle you to select a Reward from the Fit Friends Rewards Program. This Reward Voucher will contain details about how to redeem a Reward and will include your name and membership number as well as the name and membership number of the Eligible Friend you referred. The Reward Voucher will also contain your unique Reward Voucher code and security code. You will need to enter these details on the Fit Friends Rewards Program website to register your Reward Voucher code.
2. You must register your unique Reward Voucher code online before the expiry date as clearly listed on the Reward Voucher you receive from Fitness First. Follow the prompts to enter your Reward Voucher code. If you are a new visitor to the site you will be prompted to set up an account with Fit Friends. You will have the option to either redeem your Reward Voucher for a Reward from the Join 1 Friend Rewards selection at this time or Bank this code to your account for use at a later date.
3. If you refer another Eligible Friend you will receive another Reward Voucher which you can use to either: claim one (1) reward from the Join 2 Friends Rewards selection; or two (2) Rewards from the Join 1 Friend Rewards selection if you haven’t already redeemed your first Reward Voucher. You can also choose to Bank your second Reward Voucher code and achieve a third Reward Voucher by referring a third Eligible Friend.
4. If you refer a third Eligible Friend you will receive another Reward Voucher which you can use to either: claim one (1) Reward from the Join 3 Friends Rewards selection; or one (1) Reward from the Join 2 Friends Rewards selection and one (1) Reward from the Join 1 Friend Rewards selection; or three (3) Rewards from the Join 1 Friend Rewards selection if you haven’t redeemed your initial Reward Vouchers already.
5. Fit Friends Rewards Program offer period commences at 12.01am AEST 01.12.09 and closes at 11.59pm 30.12.11.

FIT FRIENDS PROGRAM TERMS & CONDITIONS

1. Information on how to qualify and the Rewards forms part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. This offer is open to all Australian residents who are active members of Fitness First Australia. Your Fitness First account must not be in arrears.
3. To qualify for a Reward from the Fit Friends Rewards Program a current member must refer an Eligible Friend who joins on an Eligible Membership at Fitness First. Referring Members will receive one (1) Reward Voucher for every new Eligible Member they refer. These Reward Vouchers can be used to claim Rewards from the Fit Friends Rewards Program.
4. Age restrictions apply to the use of some of the Rewards available. Please refer to the individual terms of the Reward for information.
5. Full contact details (full name and contact phone number) of the Referring Member must be provided when the Eligible Friend joins Fitness First. The Referring Member will be contacted by Fitness First when their Reward Voucher becomes available. The Referring Member will need to collect their Reward Voucher from Fitness First at their own discretion and show photo ID as proof of identity upon collection. Failure to do so before the expiration date of the Reward Voucher will be at the responsibility of the Referring Member and not Fitness First.
6. Fitness First staff will process the Eligible Membership and issue a Reward Voucher to the Referring Member. The Fitness First staff member will validate the Reward Voucher with the following details i) new Eligible Member name and membership number ii) Referring Member name and membership number iii) security code of authorisation. The Reward Voucher will entitle the Referring Member to select a Reward from the available Rewards on offer and full details and terms and conditions of the Rewards form part of these Terms and Conditions.
7. Referring Members will need to register their Reward Voucher code before the expiry date printed on the Reward Voucher. A Referring Member may choose to Bank and save their Reward Voucher code to redeem at a later date. Member can refer more Eligible Friends and receive further Reward Vouchers to add to their Banked account and extend the list of Rewards available to be redeemed. Once a Reward Voucher is registered, a Referring Member has a period of six (6) months to redeem this Reward Voucher from the date of registration or it will be forfeited.
8. One (1) Reward Voucher saved entitles the Referring Member to select a reward from the Join 1 Friend Rewards selection; two (2) Reward Vouchers saved entitle the Member to select either: two (2) Rewards from the Join 1 Friend Rewards selection or one (1) Reward from the Join 2 Friends Rewards selection; three (3) Reward Vouchers entitle the Referring Member to select either three (3) Rewards from the Join 1 Friend Rewards selection; or one (1) Reward from the Join 1 Friend Rewards selection plus one (1) Reward from the Join 2 Friends Rewards selection; or one (1) Reward from the Join 3 Friends Rewards selection.
9. The Rewards available are subject to availability and may change without notice throughout the life of the program. If a redeemed reward cannot be fulfilled, any substitutes offered will be of equal or higher value.
10. Once a Referring Member chooses to redeem their Reward, they will be prompted to complete an online redemption form with their full contact details and details for their Reward to be processed and submit this for processing.
11. Rewards are non transferable and may only be claimed by the Referring Member.
12. Once a redemption form is processed a Referring Member will receive a confirmation message as receipt of their order. They can expect to receive delivery of their reward or be contacted by the Fit Friends Concierge service with details about their Reward within three (3) weeks of submitting the redemption form.
13. Reward Vouchers have no monetary value (unless a Reward specifically permits), are not considered your property, and are not transferable and cannot be redeemed for cash (unless a Reward specifically permits).
14. Fitness First and The Administrator reserves the right to verify the validity of Reward claims at any time during or after the promotion, and reserves the right to refuse a Reward for any Referring Member (and ALL claims submitted by that Referring Member) for tampering with the claim process, for submitting a claim which is not in accordance with these Terms and Conditions. Failure of Fitness First to enforce any of its rights at any stage does not constitute a waiver of those rights.
15. Fit Friends ‘Refer a Friend’ offer period commences at 12.01am AEST 01.12.09 and closes at 11.59pm 30.12.11.
16. No responsibility is accepted for errors which may occur in the processing of new memberships and the associated Fit Friends ‘Refer a Friend’ Rewards Program.
17. If you have a dispute in relation to the number of Reward Vouchers which you have been awarded in respect to the introduction of Eligible Friend(s), such a dispute must be made in writing to Fitness First within one (1) month of the date of the Eligible Friend joining Fitness First.
18. All member information collected as part of the Fit Friends program remains the property of Fitness First, however Fitness First has appointed Global Red as the Administrator of the program and thereby grants the Administrator permission to use member data for the purpose of administering the Fit Friends Rewards Program and the fulfilment of the redeemed Rewards to Eligible Members.
19. Fitness First and its Fit Friends Partners may seek, collect, use, store, share or disclose your Fitness first member information for the purpose of your participation in the Fit Friends Reward Program and by referring a friend or otherwise participating in the Program, you consent to this.
20. Fit Friends is not open to employees or associates of Fitness First or the Administrator to either refer or redeem.
21. Fitness First reserves the right to withdraw the Fit Friends program at any time and at such a time, only those Rewards that have been redeemed will be fulfilled. There will be no obligation to fulfill Banked Reward Vouchers to members.
22. Fitness First or the Administrator reserves the right to vary these terms and conditions without notice as is deemed necessary.
23. The Promoter is Fitness First Australia Pty Ltd (ABN 65 094 778 622) Level 3, 55 Grafton Street, Bondi Junction NSW 2022 (“Fitness First Pty Ltd.”) and Administrator is Global Red Pty Ltd, Level 5, 15 Blue Street North Sydney NSW 2060, ABN: 92 082 096 599.

GENERAL REWARD TERMS & CONDITIONS

1. All Rewards are open to Australian residents aged 16 or over, who refer a friend(s) who subsequently join Fitness First Australia on an Eligible Membership. Other age restrictions apply to some of the Rewards and these are detailed in the individual reward terms & conditions.
2. These General Reward Terms & Conditions apply to the following Rewards: Australian Barbell Fitness Ball, Apple iPod Shuffle 2GB, New Balance Cross Trainers. For all other Rewards, please refer to their individual Terms & Conditions.
3. All individual Reward terms and conditions are to be read in conjunction with these General Terms & Conditions.
4. Following redemption and completing the relevant information online, each of the Rewards will be sent to the Referring Member via the contact details provided within 21 days of completing the online redemption process/form.
5. All bookings are subject to promotional availability. In the event that a Reward is not available despite the Administrator’s reasonable endeavours to provide the Reward, the Administrator or Fitness First reserve the right to substitute a Reward(s) to the same or equal recommended retail value and/or specification, subject to any written directions from a regulatory authority.
6. In the event that for any reason whatsoever the Referring Member does not accept the Reward, or any part thereof, at the time stipulated by the Administrator, then the Reward or any part thereof, will be forfeited.
7. All Rewards will be valid for a minimum of six months from redemption, unless otherwise stated in their individual terms & conditions.
8. Only original Reward Certificates for redeemed Rewards will be accepted at venues and these cannot be transferred, sold or exchanged for cash.
9. Fitness First, its Administrator, agents and distributors cannot replace any lost, stolen or damaged Reward Certificates. Any Reward Certificate may be judged void if it does not pass validation or is reported lost, stolen, illegible, mutilated, altered, misprinted or incomplete.
10. Each redeemed Reward Certificate may be used on one occasion only (unless otherwise stated) and cannot be used in conjunction with any other Reward Voucher or promotional offer.
11. Reward suppliers may change from those stated.
12. The Administrator is not responsible for any offer misrepresentation (written or verbal) on warranties by anyone / group other than the Administrator.
13. Fitness First, its agents or distributors cannot be held responsible for fraudulent claims, or Reward Vouchers/certificates lost or damaged in transit. If a Reward Certificate needs to be re-issued, the required number of points will be deducted from the customers account again.
14. Fitness First, the Administrator, their agents and distributors are not liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with accepting any of these Rewards, except for any liability which cannot be excluded by law.
15. Fitness First and the Administrator, their clients, agents and distributors give no warranty (whether express or implied) whatsoever with respect to Rewards. In particular, neither Fitness First or the Administrator, their clients, agents and distributors give any warranty with respect to the quality or durability of the Reward or suitability for any purpose.
16. If a reward is damaged or faulty, you must notify Concierge on 02 8117 2200 Monday to Friday 9:30am to 5:30pm EST or email customerservice@fitnessfirst.com.au within three (3) business days of receipt, giving full details.
17. Any persons taking advantage of this promotion does so on complete acceptance of the terms and conditions that apply.
